I don't understand the contravention  

The Penalty Charge Notice (PCN) was issued for contravention number 25 which relates to parking in a loading bay without loading. The signs adjacent to the parking bay would normally state  'loading only'.

We will review your Penalty Charge Notice (PCN) if you can provide us with more detailed information if you advise you were actually loading/unloading.  Depending on what you were loading or unloading, we may need you to provide the respective delivery note or a receipt/invoice for the goods being loaded/unloaded.

  • The goods being loaded/unloaded where bulky, numerous or heavy where it would not be possible to load or unload from another location. 
  • That the vehicle was only parked for  as long as necessary.

I didn't see or understand the signs

The Penalty Charge Notice (PCN) was issued for contravention number 25 which relates to parking in a loading bay without loading. The signs adjacent to the parking bay would normally state  'loading only'.  Payment to park such as pay and display tickets are not valid for use in loading bays.

I displayed a valid disabled badge

The Penalty Charge Notice (PCN) contravention number indicates that the vehicle was parked at a parking location/bay, where a disabled badge would not provide you with an exemption to park.                                                               

However,  we will review your Penalty Charge Notice (PCN) if you can provide a photocopy/photograph of your disabled badge. 

When we review your appeal we may review the following -                                                               

  • That the disabled badge was valid.                                    
  • That the badge was being used by the registered badge holder.                                                                                            
  • How many previous PCNs have been cancelled as gestures of goodwill in respect of the use of a disabled badge.

I was loading or unloading

I never received the original Penalty Charge Notice (PCN)

We would not normally cancel a Penalty Charge Notice (PCN) under these circumstances. Occasionally PCNs  are removed by third parties from vehicle windscreens.   However, the original PCN remains valid.  If you did not receive the original PCN and submit an appeal, we will investigate if we can reoffer the early payment discount.

My vehicle broke down

We will review your Penalty Charge Notice (PCN) if you can provide a photocopy/photograph of the relevant breakdown/recovery report or a receipt/invoice for parts needed to facilitate the repair of the vehicle.                     

When we review your appeal we may review the following-

  • That the breakdown/recovery report or receipts are genuine,                                                                                    
  • The breakdown could not have been predicted.  This would not include instances where the vehicle has ran out of fuel.                                                                                             
  • The vehicle was removed from the parking place within a prompt timescale.

I was a visitor to Newcastle and I was not aware of the rules/ restrictions

We would not normally cancel a Penalty Charge Notice (PCN) for this reason. Whilst you may have been unfamiliar with the restrictions it is still the responsibility of the motorist to observe and adhere to the signs and road markings.

I sold the vehicle prior to the Penalty Charge Notice being issued.

I am a vehicle hire company and the vehicle was on hire.

We will review the Penalty Charge Notice (PCN) if you can supply/upload a valid hire agreement.  When we review your hire agreement we may check that it is a valid hire agreement and was valid at the time the PCN was issued.

It maybe that another vehicle is using your vehicles registration number illegally.

  • Photographs of the front, rear and sides of your vehicle.     
  • Any documents or crime reference numbers from the police if you have previously reported this to the police.         
  • Any evidence that your vehicle was in a different part of the county when the PCN was issued.

It is not possible for Civil Enforcement Officers (CEO) to patrol every street and car park at the same time and it may be possible that CEOs may not have been patrolling this location when you previously parked.

Other vehicles were not issued with a Penalty Charge Notice

The fact that other vehicles may not have been issued a Penalty Charge Notice (PCN) does not affect yours. The other vehicles may have had an exemption to park or it may be that the other vehicles parked after the Civil Enforcement Officer had left.
