Transportation Development Guidance for Developers - December 2015

It is important that developers are encouraged to invest in Newcastle - development brings investment into the local economy, can improve the local environment and make the City a more attractive place to live, work and visit.

New development often necessitates significant changes to the highway network and it is important that developers are made aware of the processes and obligations required to complete these changes at the earliest opportunity.

A suite of four documents has been produced to further aid developers and key stakeholders as part of the development process.  Following a consultation period in 2015, four documents were approved by Cabinet on 25 November 2015. Supporting Development in Newcastle Developer Guidance Cabinet Report 25 November 2015 (pdf 113KB) 

The Design and Construction of Roads and Accesses to Adoptable Standards was approved at Committee on 24 March 2011 Committee Report 24 March 2011 (pdf 60KB) and will be updated in 2016.

If major changes are made to these documents, a full consultation process will be undertaken and approval will be required. Any changes or amendments will be posted on this page, where the latest version of the documents will be available.

The purpose of this document is to provide a practical guide that details the adoptable standards Newcastle City Council requires in relation to the design and construction of highway works. This will be of assistance to developers who wish to enter into Section 278 or Section 38 Agreements with the council. 

Appendix B relates to the palette of materials and were approved at Cabinet 25 November 2015. Supporting Development in Newcastle Developer Guidance Cabinet Report 25 November 2015 (pdf 113 KB).  The purpose of these appendices to the existing Design and Construction of Roads and Accesses to Adoptable Standards Guide is to minimise the proliferation of different paving and surfacing materials throughout the City and sets out palettes of materials for adopted highways.

Section 278 Agreements - Developer Guidance (pdf 162KB) | Appendices (pdf 174 KB) 
An agreement with a developer under Section 278 of the Highways Act 1980 is required when work on the existing public highway is needed as a consequence of development. The purpose of this document is to help developers through the process of establishing a Section 278 Agreement with Newcastle City Council.

Section 38 Agreements - Developer Guidance (pdf 158KB) | Appendices (pdf 383KB) 
An agreement with a developer under Section 38 of the Highways Act 1980 is required when a developer wishes the council to take over and maintain at the public expense (i.e. adopt) roads and footpaths. The purpose of this document is to help developers through the process of establishing a Section 38 Agreement with Newcastle City Council, setting out what developers can expect from the council, and what the council can expect from developers.

Transport Assessments, Travel Plans and Parking - Developer Guidance (pdf 1.5MB)
This developer guide provides information on Transport Assessments, Transport Statements, Travel Plans, Delivery and Servicing Plans, Construction Management Plans, cycle and car parking requirements and electric vehicle charging.  It is a material consideration in the development process and helps ensure development proposals are submitted with the necessary information.
