Dangerous Structures

Dangerous Structures

Buildings or structures considered to be dangerous can be reported to Building Control.

We will visit the site to assess the danger. If we think that a danger does exist, but not of an absolutely immediate nature, then we will contact the owners and agree a course of action. As part of this course of action the owner must agree to a time scale in which to make the building or structure safe or to remove the danger.

In some circumstances we may apply to the Magistrates Court for an order requiring the owner to do the work.

If we find the situation to be so dangerous that matters cannot wait, and the owners cannot do something immediately, we have the powers to make safe or remove the danger, with all reasonable costs recovered from the Building Owner.

Please note that the building/structure must pose a safety risk in order for Building Control to present a case for enforcement under Section 77 and 78 of the Building Act 1984. An empty building, open to access or in an unsightly or ruinous condition may not be considered a dangerous structure.
