Saved UDP policies

Background

Under the Planning and Compulsory Purchase Act 2004, all policies in existing development plans including our UDP were 'saved' until 27 September 2007. Beyond that date policies had to be further saved by direction of the Secretary of State for Communities and Local Government under paragraph 1(3) of Schedule 8 to the Act.

A Direction was issued on 31 August 2007, saving 128 policies and allowing 67 to expire. Lists of saved and unsaved policies are given below on this page, but you might find one of the following downloadable documents more useful for reference or printing:

* Development Control Policy Statements

The following statement re DCPSs is contained in the Local Development Scheme of April 2007:

"The UDP for Newcastle adopted in 1998 included at the end a set of 23 Development Control Policy Statements. The UDP described these as setting out 'those planning considerations which may be material in the determination of planning applications and appeals, and the conditions which may be attached to permissions, concerning the type of proposals to which each Statement refers. They are part of the UDP and are thus distinct from, and of a higher status than, Supplementary Planning Guidance, which supplements the policies and proposals of the UDP and is issued separately from it.'

The Planning and Compulsory Purchase Act 2004 only saved development plan ‘policies’ beyond September 2004. The status of the Development Control Policy Statements is therefore perhaps uncertain. To give them a greater degree of certainty, the Council through approving this Local Development Scheme is indicating that it still believes that these statements have a useful purpose, are consistent with saved UDP policies and should continue to be used in a supporting role in development control until the LDF is fully in place."

Proposals Map

The Proposals Map adopted as part of the UDP in 1998 still stands, except that it has been superseded in part by the Proposals Map for the Walker Riverside Area Action Plan.
